Terms & Conditions

Bookings are made and accepted based on the following conditions:

1. CONTRACT AND BOOKING

1.1. This agreement is made on the basis that the property ("the Property") is to be occupied by the guests for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Guests acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.

1.2. Bookings cannot be accepted from persons under 18 years of age.

2. INTERPRETATION

2.1. Any obligation on the Guest in this Agreement not to do an act or thing includes an obligation not to permit or suffer another person to do such act or thing.

2.2. Whenever there is more than one person comprising the Host or the Guest their obligations may be enforced against all of them jointly and against each of them individually.
  2.2.1. The Host and Guest do not intend that this Agreement should be enforceable by any person solely by virtue of the     Contracts (Rights of Third Parties) Act 1999

3. RENT, DEPOSIT AND OTHER APPLICABLE FEES

3.1. Rent shall mean the amount payable for the duration of the stay agreed

3.2. Booking Deposit shall mean the deposit of 15% of the Rent

3.3. Applicable Fees shall mean
 3.3.1. Pet Fee: £25 per dog per stay
 3.3.2. Hot Tub: £250 per stay

3.4. The Guest must pay the Booking Deposit to the Host on date of the agreed booking of this Agreement.

3.5. The Guest must pay the balance due of the Rent and any other Applicable fees (pet and/or hot tub) to the Host at least 8 weeks before the Start Date

3.6. If damage has been caused or there are other costs incurred due to the Guest/s failing to comply by their Obligations in section 6, any reasonable costs will be deducted.

3.7. Any dogs the Guest wishes to bring should be declared at the time of booking, checked and authorised via the Host.

3.8. No bookings are valid until confirmed in writing and the deposit or full payment is received.

3.9. Payments by the following cards: Visa, Mastercard, American Express.

4. CHECK-IN / CHECK-OUT

4.1. Check in is from 4pm and check out is before 10pm. 4.2. We reserve the right to change these times as required. 4.3. An earlier check in of 2pm or later check out of 12pm may be possible. To request this, please contact your local housekeeper to see if this is possible. Please contact your local housekeeper if you have any questions about check in/check out or need anything or have any issues during your stay.

5. HOST’S OBLIGATIONS & RESPONSIBILITIES

5.1. The Host is solely responsible for providing the Property and for the safety of all Guests and/or his/her invitees (jointly known as "the Guests").

5.2. The Host accepts no responsibility for personal injury to, or death of, any Guests, or loss of or consequential loss or damage to their property, or for other matters over which we have no control, except to the extent such personal injury or death is caused by the negligence or wilful default.

5.3. The Host agrees with the Guest:
 5.3.1. That the Guest may quietly possess and enjoy the Property during the Rental Period without any interruption from the Host or any person claiming under or in trust for the Host.
 5.3.2. To provide adequate bed linen and towels at the Property.
 5.3.3. To provide an adequately equipped kitchen to ensure almost all reasonable needs are met.
 5.3.4. To present the property fully cleaned and tidy.
 5.3.5. That all amenities are fully functioning and that should there be any faults these will be rectified within a reasonable timeframe – ideally within 24 hours.

6. GUESTS’ OBLIGATIONS & RESPONSIBILITIES
The Guest agrees with the Host:

6.1. To use the Property in a reasonable and careful manner and not allow it to deteriorate and to keep the Property clean and tidy at all times.

6.2. To make good or agree to pay for making good all damage caused to the Property (including the Host’s fixtures and fittings) through:
 6.2.1. any breach of the obligations set out in this Agreement;
 6.2.2. any improper use by or negligence of the Guest or any person at the Property with the Guest’s permission. 6.3. To keep items in the property clean and in the same condition as at the commencement of the Rental Period (fair wear and tear and damage by insured risks only excepted) and to make good or replace with articles of the same sort and equal value such as may be lost broken or destroyed (or at the option of the Host to pay compensation to the Host). 6.4. Not to block or otherwise damage the taps baths wash basins WCs cisterns or pipes within or exclusively serving the Property. 6.5. To keep the Property heated to a reasonable level during the winter months to prevent damage to the Property or the water pipes drains tanks and other plumbing apparatus by cold weather.

6.6. To report to the Host any damage destruction loss defect or disrepair affecting the Property as soon as it comes to the attention of the Guest.

6.7. To place all refuse in the bins provided for the Property by the Host or any other competent authority.

6.8. To allow the Host and/or their agent or anyone with the Host’s written authority together with any contractor or gardener and necessary appliances to enter the Property (including Garden) at reasonable times of the day to inspect its condition and state of repair and to carry out any necessary repairs provided the Host has given reasonable notice (with regard to the work to be undertaken) beforehand and not to interfere with or obstruct any such persons

6.9. In cases of emergency to allow the Host or anyone with the Host’s authority to enter the Property at any time and without notice.

6.10. To use the Property as a private holiday residence for a maximum of 9 people only.

6.11. Not to do anything on the Property which may be a nuisance to or cause damage, excessive noise or annoyance to the Host or the Guests or occupiers of any adjoining property.

6.12. Not to play any musical instrument or other device which can be heard outside the Property after 9pm or before 8am.

6.13. Not to use the Property for any illegal or immoral purposes.

6.14. Not to use the Property in a way which contravenes a restriction affecting the Host’s freehold (or superior leasehold) title which the Host has brought to the Guest’s attention.

6.15. Not to cause or permit any dangerous or inflammable substance to collect in or on the Property apart from those needed for general domestic use.

6.16. Not to display any notice or advertisement that is visible from outside the Property.

6.17. Not to keep on the Property any animal or pet without first obtaining the Host’s written consent and subject to any conditions imposed by the Host.

6.18. Not to smoke at the Property.

6.19. To comply with any planning conditions affecting the Property which the Host has brought to the Guest’s attention.

6.20. Not to assign or sublet the Property or any part of the Property and not to part with possession or share occupation of the Property or any part of it.

6.21. Not to permit any person to occupy the Property as a lodger.

6.22. Not to alter add to or interfere with the appearance structure exterior or interior of the Property or the arrangement of the fixtures furniture and effects belonging to the Host.

6.23. At the end of the Rental Period to remove the Guest’s belongings from the Property, including any food, and leave the Property clean and tidy.

7. FORFEITURE

7.1. If there has been a substantial breach of any of the Guest’s obligations in this Agreement the Host may forfeit the tenancy (i.e. bring it to an end) and recover possession of the Property. The other rights and remedies of the Host will remain in force.

7.2. The Guest must report and pay to the Host the cost of any damage or breakages made during their holiday occupancy. The Host reserves the right to make a reasonable charge where guests have contravened an Host's request for their Property to be smoke-free.

7.3. The Guests' right to occupy the Property may be forfeited without compensation if:
 7.3.1. More people or pets than declared at the time of booking or before the commencement of the holiday and/or the number the Property holds, attempt to take up occupation.
 7.3.2. Overnight guests are entertained without the Host's express permission
 7.3.3. Any activity is undertaken which is illegal, or may cause unreasonable damage, noise, behaviour or disturbance; or
 7.3.4. Any of the Guest’s smoke in or at the Property.

8. CANCELLATIONS

In the event of cancellation, Guests may be due a partial refund which is dependent on when notice of cancellation is given before the holiday start date.

8.1. If the Guest terminates this Agreement (i.e. cancels the booking) more than 8 weeks before the Start Date the Host shall refund the full amount paid (including the Deposits).

8.2. If the Guest terminates this Agreement between 4 and 8 weeks before the Start Date the Rent, Damages Deposit and any other applicable fee will be refunded minus the Booking Deposit

8.3. If the Guest terminates this Agreement between 2 and 4 weeks before the Start Date the damages deposit and any applicable fees and 25% of the rent will be refunded unless the stay is successfully rebooked in which case the rent will be refunded minus the Booking Deposit

8.4. If the Guest terminates this Agreement less than 2 weeks before the Start Date the Damages Deposit and any applicable fees will be refunded but there will be no refund of the Rent.

8.5. If the Guest has not paid the Rent by the date that the balance of the Rent is due, the Guest will be deemed to have terminated the Agreement and the Booking Deposit will not be refundable.

8.6. If a refund is due, it will be paid within 15 working days of cancellation

8.7. We reserve the right to change these terms as required. The terms at the time of the guests booking will continue to apply.

9. UNAVAILABILITY OF THE PROPERTY

9.1. In the event of the Property becoming unavailable (such as due to fire or flooding), we will endeavour to provide the Guest with suitable alternative Property or will refund all monies paid, or a proportion in the case of curtailment.

9.2. We cannot, however, pay any compensation or expenses as a consequence of such an event.

10. ALTERATIONS TO BOOKINGS

A Guest requiring a booking to be altered once the booking has been confirmed may incur a £30 admin fee and is subject to agreement.

11. PETS / DOGS

Guests wishing to take pets on holiday must abide by the following rules:

11.1. "Pets welcome" relates to properties which allow pets and refers only to fully house-trained dogs.

11.2. Young pets (e.g. puppies) MUST be declared at the time of booking and authorised by the Host. If a puppy or young pet (i.e. under 12 months) is taken to a Property without the consent of the Host this could result in you being asked to leave without compensation. When booking online it is advised you check the acceptance of your pet by emailing or noting it on the booking enquiry form.

11.3. We request that dog Hosts to observe the following (failure to do so may result in you being asked to leave without compensation):
 11.3.1. Dogs must be under strict control at all times while in or at the Property;
 11.3.2. Any fouling must be cleared up without delay;
 11.3.3. Dogs MUST NOT be left alone in or at the Property or elsewhere at any time
 11.3.4. Dogs MUST NOT lie on beds or directly on furnishings, and hair must be cleared up before departing
 11.3.5. Dog Hosts must ensure that their pets are free from parasites and fleas before they occupy the Property. Failure to do so will incur subsequent charges
 11.3.6. Any damage (which must be reported to the Host immediately) or excessive cleaning that may incur an additional charge, will be at the Host’s discretion.

12. COMPLAINTS PROCEDURE

12.1. In the event of there being cause for complaint concerning a Property, the matter shall be taken up with the Host (or Host’s caretaker/housekeeper) at once (details are supplied on the booking confirmation, and they understand that they are the first point of contact should there be cause for complaint).

12.2. It is important that this is done whilst you are still at the Property so that an on-the-spot investigation can be made if necessary and remedial action taken if required.

12.3. Compensation is unlikely to be considered for complaints raised after the holiday has ended, when guests have denied the Host/Caretaker/Housekeeper the opportunity of investigating the complaint and endeavouring to remedy matters during the holiday.

13. LITERATURE

13.1. We have compiled the information in our literature and on our Website as accurately as possible at the time of going to press. However, facilities may be altered or withdrawn for reasons outside our control. We make every effort to ensure that the Property reflects the details provided.

13.2. The Guests accept that minor differences between text / photographs / illustrations in the brochure and on the Website and the actual Property may arise. If a facility is particularly important to you, please check with us prior to your booking.

14. COMMUNICATION AND DATA

15. LEGAL

Any dispute, claim or other matter which may arise in relation to your booking will be governed by English law and you agree that any dispute will be dealt with exclusively by the courts of England and Wales.

16. The Booking Conditions will apply to all confirmed bookings
